RECENT SUPREME COURT DECISIONS ON ANTI-TRUST LAW
Your text cites the long-standing case of Dr. Miles Medical Co. v. John D. Park & Sons Co., 220 U.S. 373 (1911). For nearly 100 years, the ruling in this case made it illegal per se under the Sherman Act for a manufacturer and its distributor to agree on the minimum price the distributor could charge for the manufacturer's goods. Resale price maintenance agreements (RPMs) have long been found to be illegal per se. On June 28, 2007, The U.S. Supreme Court overturned Dr. Miles in the following case.
